Internal investigations: 7 legal safeguards recommended for greater effectiveness (In French)

National newspaper Les Echos interviews Stéphane de Navacelle along with Dominique Perben (Simon Associés) and Raphaël Gauvain (Stephenson Harwood), reacting to a Club des Juristes pivotal report on internal investigations of which they are co-rapporteurs, presenting 7 legal safeguards for a more effective and balanced framework.

The leading French legal think-tank Club des juristes will publish on June 17, 2025, a pivotal report presenting 7 legal safeguards aimed at improving the effectiveness of internal investigations while safeguarding employee rights.

Amid a growing number of whistleblower reports of harassment, discrimination, or fraud, these recommendations seek to provide structure to a practice that remains too often improvised. When properly conducted, an internal investigation can become a strategic lever, particularly in negotiations with authorities, both in France and internationally.

These proposals could help avoid overly rigid legislation while reinforcing trust in these sensitive mechanisms.

A must-follow topic for legal, HR, and compliance departments.
